1. Introduction and Acceptance of Terms
Welcome to Elkhorn Home Management (“EHM,” “we,” “us,” or “our”).
EHM is a locally owned and operated property management company based in Big Sky, Montana. We provide vacation rental management and guest booking services for homes, cabins, townhomes, condominiums, and other accommodations in Big Sky and surrounding areas.
These Terms and Conditions (“Terms”) govern your access to and use of https://www.ehmmt.com/ (the “Website”), including browsing property listings, submitting inquiries, making reservations, and communicating with our team.
By accessing the Website or making a reservation through EHM, you agree to these Terms, the cancellation policy applicable to your reservation, and any property-specific rules or rental agreement provided to you. If you do not agree, please do not use the Website or make a reservation.
2. EHM's Role and Property Management
EHM manages vacation rental properties on behalf of property owners and coordinates services related to reservations, guest communications, property access, housekeeping, and property maintenance.
Unless expressly identified otherwise in your reservation documents, EHM acts as the property manager or authorized booking representative for the applicable property owner. EHM does not necessarily own the property you reserve.
The property owner retains ownership of the accommodation, while EHM manages the property and guest experience within the scope of its authority.
Your reservation is subject to these Terms, the confirmed booking details, the property's disclosed rules, and any applicable rental agreement.
Nothing in these Terms limits EHM's or a property owner's obligations under applicable law.
3. Eligibility and Guest Information
You must be at least 18 years old and legally capable of entering into a binding agreement to make a reservation.
When booking, you agree to provide accurate information, including your name, contact details, arrival and departure dates, number of guests, and any other information reasonably required to process your reservation.
You are responsible for ensuring that all members of your traveling party comply with these Terms and the rules applicable to the property.
EHM may request reasonable identity or reservation verification when necessary to prevent fraud, protect property, or comply with legal requirements.
4. Property Listings and Availability
EHM makes reasonable efforts to ensure that property descriptions, photographs, amenities, occupancy limits, location information, and availability displayed on the Website are accurate.
However, photographs and descriptions are intended to represent the property and may not reflect every current furnishing, decorative detail, seasonal condition, or minor change.
Amenities, views, landscaping, access routes, and services may occasionally be affected by weather, maintenance, supplier availability, or circumstances outside EHM's reasonable control.
Rates and availability may change until a reservation is confirmed.
A property is not reserved merely because you have viewed it, added it to your favorites, submitted an inquiry, or entered dates into the search tool.
A reservation becomes confirmed when the booking process is completed, any required payment or authorization is obtained, and EHM or its booking system issues a confirmation.
5. Reservation Prices, Fees, and Taxes
The total price of a reservation will be presented during the booking process and may include:
- Nightly accommodation charges.
- Cleaning fees.
- Administrative or booking fees.
- Hot tub cleaning fees, where applicable.
- Pet fees or approved additional guest charges, where applicable.
- Optional services, such as cribs or high chairs.
- Applicable lodging, resort, sales, or other taxes.
The fees and services applicable to each property will be identified in the listing, checkout details, or booking confirmation.
Guests are responsible for the amounts disclosed and accepted when making the reservation, subject to applicable refund rights and legal requirements.
EHM will collect, report, or remit taxes as required by law and the applicable booking arrangements. Property owners and other responsible parties remain responsible for any tax obligations assigned to them by law.
If a pricing or listing error is discovered, EHM will work with the guest to resolve the issue in accordance with the booking agreement and applicable law.
6. Payment Terms
Payments must be made using the payment methods and schedule specified during the reservation process.
By submitting payment information, you authorize the applicable payment processor or authorized booking provider to process the disclosed charges for your reservation.
Depending on the property and booking terms, payment may be collected in installments or in full before arrival.
Failure to make a required payment may result in cancellation of the reservation in accordance with the applicable booking policy and law.
EHM may use third-party reservation and payment-processing services to facilitate bookings. Payment processing is subject to the applicable provider's terms and security procedures.
7. Cancellation, Changes, and Refunds
The cancellation policy displayed for your specific property and reservation controls.
Cancellation terms may vary by property, rate plan, booking date, and arrival date. You are responsible for reviewing the applicable policy before completing your reservation.
EHM property listings may provide for cancellation without penalty up to one month before check-in, with a charge equal to the full rental amount for cancellations one month or fewer before check-in. No-shows may be subject to forfeiture of the applicable prepaid amount.
Your booking confirmation and the policy accepted during checkout determine the terms applicable to your stay.
To request a cancellation or modification, contact EHM at info@ehmmt.com or (406) 995-7917. A cancellation or change is not effective until processed or confirmed in accordance with the applicable policy.
Changes to dates, occupancy, or property selection are subject to availability and may result in different rates or additional disclosed charges.
If EHM or a property owner must cancel a confirmed reservation because the property becomes unavailable, EHM will notify the guest and provide the refund or other remedy required by the applicable booking agreement and law.
Unless otherwise provided by the applicable policy or law, guests who depart early, arrive late, or do not use all reserved nights are not automatically entitled to a refund.
Nothing in this section waives any refund or remedy required by law.
8. Security Deposits and Damage Protection
Some properties require a refundable security deposit, credit card authorization, or other disclosed damage protection arrangement.
Any required deposit, its amount, the payment method, and the applicable conditions will be communicated during booking or in the reservation documents.
Guests are responsible, to the extent permitted by law, for damage to the property, furnishings, appliances, equipment, or other items caused by them or members of their party beyond ordinary wear and tear.
EHM may document property condition and investigate reported damage before and after a stay.
Any damage charge or deduction from a deposit must be reasonably supported and handled in accordance with the applicable rental agreement and law.
Guests are not responsible for ordinary wear and tear or for damage they did not cause.
9. Check-In and Check-Out
Unless your reservation confirmation states otherwise, EHM's standard check-in time is 4:00 p.m. MST and standard check-out time is 10:00 a.m. MST
Property-specific instructions or confirmed arrangements may differ.
Guests must follow the check-in instructions provided by EHM and use the designated access method for their reserved property.
Early check-in and late check-out are subject to approval and availability. Additional fees may apply if disclosed before the arrangement is accepted.
At departure, guests must follow the property's check-out instructions, secure the premises, and return keys or access devices as directed.
Unauthorized late departure may result in additional charges where disclosed in the booking terms and permitted by law.
10. Occupancy and Permitted Use
Each property has a maximum permitted occupancy, which may be based on sleeping arrangements, safety requirements, local regulations, or community rules.
Guests must not exceed the occupancy limit stated in the listing or reservation confirmation without prior written approval from EHM.
The property may be used only for the residential vacation stay described in the reservation.
Unless expressly authorized, guests may not:
- Host parties, weddings, events, or large gatherings.
- Sublet, transfer, or commercially use the property.
- Use the property for unlawful activities.
- Remove furnishings or equipment from the property.
- Interfere with safety devices or property systems.
- Engage in conduct that creates unreasonable disturbance, damage, or danger.
Unauthorized use may result in termination of the stay where legally permitted, as well as lawful charges or other remedies under the applicable rental agreement.
11. House Rules, Neighbors, and Community Requirements
Guests must comply with the property's posted rules, community or homeowners' association requirements, applicable noise restrictions, parking rules, and local laws.
Smoking and vaping are prohibited at all properties.
Pets are permitted only at properties where they are expressly allowed and subject to the applicable pet rules and disclosed fees. Assistance animals will be handled in accordance with applicable law.
Guests must properly dispose of trash, respect neighboring properties, and use shared facilities and parking areas responsibly.
Guests are responsible for ensuring that everyone in their party understands and follows the applicable rules.
12. Property Maintenance and Guest Support
EHM works to maintain its managed properties and prepare them for guest arrivals.
If you discover a maintenance issue, missing amenity, cleanliness concern, or safety problem during your stay, contact EHM promptly at (406) 995-7917 or info@ehmmt.com.
EHM will make reasonable efforts to address reported issues as promptly as circumstances permit.
Certain repairs may require access by EHM staff, property owners, contractors, or service providers. Where practicable, EHM will provide advance notice and coordinate access with the guest, except in emergencies or other circumstances where immediate access is reasonably necessary and legally permitted.
Temporary interruptions to internet service, utilities, appliances, hot tubs, heating, or other amenities may occur due to maintenance, weather, utility providers, or circumstances beyond EHM's reasonable control.
EHM will assess reported problems and any applicable remedy in accordance with the reservation terms and law.
13. Big Sky Weather, Winter Access, and Mountain Conditions
Big Sky, Montana, is a mountain destination where weather and road conditions may change rapidly.
Guests acknowledge that travel to and use of mountain properties may involve snow, ice, steep driveways, unpaved roads, wildlife, variable visibility, freezing temperatures, and other seasonal conditions.
Certain properties may require four-wheel drive or all-wheel drive vehicles, winter tires, or other appropriate equipment during winter conditions. Guests must review property-specific access instructions and prepare accordingly.
Guests are responsible for monitoring weather and road conditions, complying with road restrictions and official safety instructions, and exercising reasonable care when traveling to and using the property.
EHM does not guarantee that roads, ski areas, trails, lifts, recreational facilities, or third-party services will remain open or available during a guest's stay.
14. Outdoor Recreation and Personal Safety
Big Sky offers access to skiing, snowboarding, hiking, mountain biking, fishing, and other outdoor activities.
Participation in these activities may involve risks of injury, property damage, changing conditions, or other hazards.
Any general travel or recreation information provided by EHM is for convenience and is not a guarantee of safety or conditions.
Guests are responsible for making informed decisions about recreational activities, using appropriate equipment, following safety instructions, and complying with applicable laws and restrictions.
Guests must follow posted warnings, fire restrictions, evacuation instructions, and wildlife safety guidance issued by relevant authorities.
Nothing in these Terms releases EHM or another party from liability where such a release is prohibited by law.
15. Pets and Animals
Pet policies vary by property. Guests may bring pets only when permitted by the applicable listing and reservation terms.
Guests who bring approved pets must comply with any disclosed pet fees, restrictions, and cleaning requirements and must prevent damage, excessive noise, or disturbance.
Guests are responsible for damage or additional cleaning costs attributable to their pets to the extent permitted by the applicable agreement and law.
Requests involving service animals or other legally protected assistance animals will be handled in accordance with applicable law. No provision in these Terms is intended to exclude rights or accommodations required by law.
16. Property Access and Emergencies
Guests must keep keys, access codes, and other entry credentials secure and must not provide them to unauthorized persons.
EHM, property owners, and authorized service providers may access a property when reasonably necessary for emergency response, urgent repairs, maintenance, inspections, or other legitimate property-management purposes, subject to applicable law and the terms of the reservation.
Except in emergencies or other circumstances where immediate entry is legally permitted, reasonable notice will be provided where required.
Guests must promptly notify EHM of lost keys, compromised access codes, damage, suspected security problems, or conditions that may endanger occupants or the property.
In an immediate emergency, guests should contact 911 or the appropriate emergency service.
17. Force Majeure and Unforeseen Circumstances
EHM and the property owner are not responsible for circumstances beyond their reasonable control to the extent permitted by law.
Such circumstances may include severe weather, wildfire, natural disasters, government orders, road closures, utility outages, public emergencies, or other extraordinary events.
If an event materially affects a reservation, EHM will communicate with the guest and administer the reservation in accordance with the applicable booking policy, rental agreement, and law.
Alternative accommodations, date changes, refunds, or other remedies will be handled as provided by those terms and applicable law.
This section does not eliminate any legal obligation that cannot be excluded.
18. Website Use and Intellectual Property
All Website content, including original text, design, branding, graphics, and other materials owned by or licensed to EHM, is protected by applicable intellectual property laws.
You may use the Website for personal, lawful purposes, including researching properties and making reservations.
You may not copy, reproduce, distribute, commercially exploit, or modify protected Website content without authorization, except as permitted by law.
You may not interfere with Website security, attempt unauthorized access, upload malicious code, scrape information in violation of applicable law, or use the Website for fraudulent or unlawful purposes.
EHM may modify, suspend, or discontinue Website features for operational, maintenance, or security reasons.
19. Website Information and Third-Party Services
EHM strives to keep Website information accurate and current but does not guarantee uninterrupted access or the absence of technical errors.
The Website may use third-party booking software, payment processors, hosting providers, analytics services, or other technical services to support its operation.
Third-party services may be subject to separate terms and privacy practices.
EHM is not responsible for third-party acts or omissions to the extent permitted by law. Nothing in this section excludes EHM's own legal obligations or liability where exclusion is prohibited.
20. Privacy and Cookies
EHM collects and uses personal information to respond to inquiries, process reservations, communicate with guests, provide property-management services, maintain Website functionality, and fulfill legal obligations.
The Website may use necessary, functional, analytics, and other cookies or similar technologies as described in its Cookie Policy and Privacy Policy.

Personal information will be handled in accordance with the applicable Privacy Policy and law.
21. Limitation of Liability
To the maximum extent permitted by applicable law, EHM will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from Website use or a reservation where such exclusions are lawful.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, negligence, breach of a non-waivable legal duty, or any other liability that cannot legally be excluded or limited.
EHM's responsibilities concerning a particular property or reservation are subject to its role as property manager or authorized booking representative, the applicable rental agreement, and applicable law.
No provision in these Terms is intended to eliminate a guest's rights or remedies that cannot lawfully be waived.
22. Indemnification
To the extent permitted by law, guests are responsible for claims, damages, and reasonable expenses arising directly from their unlawful conduct, fraud, or material breach of these Terms.
Nothing in this section requires a guest to indemnify EHM for EHM's own negligence, willful misconduct, violation of law, or other conduct for which indemnification cannot legally be required.
23. Governing Law and Disputes
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles, except where applicable law requires otherwise.
The parties are encouraged to attempt to resolve concerns through good-faith communication with EHM before commencing formal proceedings.
Any legal proceedings will be brought in a court of competent jurisdiction in Montana unless applicable law requires a different venue.
Nothing in this section limits rights or remedies that cannot legally be restricted.
24. Changes to These Terms
EHM may update these Terms from time to time to reflect changes in its services, Website features, or legal requirements.
The current version will be posted on the Website with its effective or last-updated date.
Changes will not retroactively alter an existing confirmed reservation unless agreed by the parties or otherwise permitted by applicable law.
25. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
These Terms, together with the confirmed reservation, applicable cancellation policy, property rules, and any separately accepted rental agreement, govern the guest's use of the Website and the relevant stay.
If a property-specific agreement conflicts with these Terms, the property-specific agreement will control the relevant stay-specific issue to the extent it was properly disclosed and accepted and is consistent with applicable law.
Failure to enforce a provision does not constitute a waiver of that provision.
